Maryland has enacted a Foreign Depositions Act ("UFDA"). See Maryland Code, Courts and Judicial Proceedings 9-401, 9-402, and 9-403. Essentially, the act provides that, when there is satisfactory proof of litigation filed outside of the State of Maryland, Maryland will allow its courts to be used to enforce the attendance of an individual in Maryland. This is only possible when there is a right to take the deposition of that individual in the litigation. (See also, Judge John T. Fader, Maryland Practice and Civil Procedure, vol. II. 2008. )

Under section 9-402 of the Uniform Foreign Deposition Act, to request issuance of a subpoena, the party shall

1. submit a foreign subpoena to the clerk of the Circuit Court for the County in which discovery is sought to be conducted in this State. Maryland Code: Courts and Judicial Proceedings 9-402(a)(1).
2. pay a filing fee of $50 to cover the costs of opening a new case in the State of Maryland. The check should be made payable to the Circuit Court of the appropriate county.

A request for the issuance of a subpoena does not constitute an appearance in the courts of Maryland. Maryland Code: Courts and Judicial Proceedings 9-402(a)(2). When a party submits a foreign subpoena to a clerk of court in this state, the clerk, in accordance with that court's procedure, shall promptly issue a subpoena for service to the person to whom the foreign subpoena is directed. Maryland Code: Courts and Judicial Proceedings 9-402(b).

A subpoena under the UFDA shall incorporate the terms used in the foreign subpoena and contain the names, addresses, and telephone numbers of all counsels of record in the proceeding to which the subpoena relates and of any party not represented by counsel. Once a subpoena under the UFDA is issued, Rule 2-510 governs the manner of service. See MD Rules 2-510.
